Sales Terms and Conditions

No orders will be processed without full payment received.

Once the order has been placed, the client or any third party cannot hold Diaan Daniels Couture responsible for the chosen gown, gown colour or gown size.

Please ensure that the relevant size charts are followed before placing your orders. Please measure yourself accurately and order the dress as per size chart and not as per usual clothing size.

We reserve the right to modify our Terms and Conditions at our discretion.

1.Amendment to the General Business Terms and Conditions
We reserve the right to amend these Terms and Conditions at any time. All amendments to these Terms and Conditions will be available online. It is your responsibility to ensure that you are satisfied with the terms and conditions. Should you not be satisfied with the amendments, you must refrain from placing any orders or from utilising the Site, as continued use of the Site will be deemed to constitute acceptance of the new Terms and Conditions. Diaan Daniels Couture is a specialized designer and retailer of luxury handmade Wedding Gowns. All products presented on our website are handmade by highly skilled seamstresses using some of the best quality Materials/Fabrics available.

2.TAKE NOTE
The items displayed on the Online Shop are the ONLY items currently in stock.
All weddings gowns are ordered according to the sizes and details provided by you. All wedding gown ordered will be verified for accurate sizing within 48 business hours.
Upon item receipt by you, the wedding gown would still need to undergo tailoring/alterations for the gown to fit you perfectly.

3. SHIPPING
Diaan Daniels Couture Wedding Gowns and Victoriamo Wedding Gowns are currently sold exclusively within the borders of South Africa. For sales enquiries please contact info@diaan.co.za

4. DELIVERY
A flat rate of R350.00 will be charged for Globe Flight postage to your specified address. Delivery can take 2-5 working days from confirmation of shipping date.
We utilise the services of Globe Flight. Once your order has been shipped, you will receive an email confirmation with your tracking number. Please click on the following link to track your order: https://globeflight.co.za/

Once the order has been shipped, and the tracking number has been sent to you, Diaan Daniels Couture cannot be held liable for any delivery-related problems.
If you reside in an outlying area, or the area where you live is not serviced by Globe Flight in South Africa - special arrangements will need to be made.

Collecting from retail store
Items can also be collected from Diaan Daniels Couture at 15 Kingfisher Drive Fourways free of charge, should you decide to not have your parcel delivered. Please note that a packaging fee of the wedding gown will be charged at R150.00.

5. PAYMENT
Option 1
Pay online. Once the payment has been cleared in our bank account the item or items requested will be ordered within 48 hours / 2 business days. Please note that should the order be received on an alternate day such as a public holiday or Sunday the order will be placed on the following available business day. Should you place an order and no payment is received in the prescribed time allocation of 60 minutes your order will be automatically be cancelled. You would then have to resubmit your order online should continue. Once the order has been received it takes 3-4 months for your order to be dispatched for delivery. Diaan Daniels Couture will keep you updated on a monthly basis on your order expectancy.

Option 2
Pay with Credit Card in store at Diaan Daniels Couture (Pty) Ltd, 15 Kingfisher Drive, Fourways, Johannesburg, Gauteng, South Africa, 2055,  should you wish not to pay online.

6. RETURN POLICY
If you are not satisfied with your purchase the item can be couriers back to Diaan Daniels Couture within 7 working days after receipt of the item. Please note we do not cover the postage or courier cost to return. Please notify Diaan Daniels Couture on info@diaan.co.za prior to returning the item and the reason. The item must be returned in its original condition as delivered and in the same packaging with the swing tag still attached. All refunds will only be processed once we are in possession of the item in question.

Damaged or defective items will be replaced prior to a Cash refunds given if the item is found to have a manufacturing defect. Please contact Diaan Daniels Couture on info@diaan.co.za within 2 days / 48 hours of receipt of the Wedding Gown.

A return courier cost will be arranged by yourself and at your cost. If the item is found to be defective a full refund including the price of the original purchase, shipping and cost of return will be refunded.

If any damage is deemed to be fair wear and tear a quote to repair will be forwarded.
Insurance - The item is insured against theft and accidental damage until the item has been couriered to the respective address you have provided

Returns Policy Conditions
The product can only be returned if the following guidelines are followed:
You return the item within 7 days of purchased
The item is in its original salable condition
With all original branding, tags and swing tickets.
In an unworn, unopened and unused state
In original packaging – the product must be returned with its original box
If you do not comply with these requirements, Diaan Daniels couture reserves the right to refuse an exchange or refund on any item returned or requested to be returned.

Interpretation
A ‘business day’ means any other day besides a Saturday, Sunday or national holiday.
The headings in these terms and conditions are for convenience only and will not affect their interpretation.
Words implying the singular number include plural and vice-versa.

Goods
The description of the goods is set out on our online shop and on our website, unless expressly changed in our terms and conditions. In accepting the terms and conditions, you acknowledge that you have not relied upon any statement, promise or other representations about the products we provide. Descriptions of the goods set out in our sales website are intended as a guide only. Each piece is unique and will vary.
We can make any changes to the specifications of the goods which are required to conform to any applicable safety, or other statutory or regulatory requirements.

Price
The price of the goods is set out on this website current at the date of your order and stands.
The price of goods is set and not subject to any discounts or reductions.
The price of is exclusive of fees for packaging and transportation/delivery within South Africa.
The price is inclusive of any applicable tax and or other taxes or levies which are imposed or charged by any competent authority.

Cancellation and Alteration
Once you have made a purchase on our website, the sale is considered final.

Law and Jurisdiction
These terms and conditions are governed by and interpreted according to South African law. All disputes arising under these terms and conditions are subject to the exclusive jurisdiction of the South African courts.

7. Circumstances beyond our control (force majeure clause)
We shall not be liable to you for any breach, hindrance or delay in the performance of a Contract attributable to any cause beyond our reasonable control, including without limitation any natural disaster and unavoidable incident, actions of third parties (including without limitation hackers, suppliers, governments, quasi-governmental, supra-national or local authorities), insurrection, riot, civil commotion, war, hostilities, warlike operations, national emergencies, terrorism, piracy, arrests, restraints or detainments of any competent authority, strikes or combinations or lock-out of workmen, epidemic, fire, explosion, storm, flood, drought, weather conditions, earthquake, natural disaster, accident, mechanical breakdown, third party software, failure or problems with public utility supplies (including electrical, telecoms or Internet failure), shortage of or inability to obtain supplies, materials, equipment or transportation (“Event of Force Majeure”), regardless of whether the circumstances in question could have been foreseen.
